1. Introduction

Welcome to Cults3D Insights ("we," "our," or "us"), a service provided by Shining Muffin LLC. These Terms of Service ("Terms") govern your access to and use of the Cults3D Insights platform, including any associated websites, content, and services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. Relationship with Cults3D

Cults3D Insights is an independent service and is not affiliated with, endorsed by, or officially connected to Cults3D. We are a third-party analytics platform that uses the Cults3D API with permission to provide insights and analytics for Cults3D creators.

While we use the Cults3D name to describe the platform our service analyzes, we do not claim any ownership of the Cults3D brand, trademarks, or intellectual property. Cults3D is a registered trademark of its respective owners.

Our service operates independently and any issues, concerns, or questions about Cults3D Insights should be directed to us, not to Cults3D.

3. Account Registration and Eligibility

To use certain features of the Service, you may be required to register for an account. When you register, you agree to provide accurate, current, and complete information about yourself and to update such information as necessary.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

Eligibility. You must be at least 18 years old, or the age of majority in your jurisdiction, to subscribe to a paid plan or make any payment, and at least 16 years old to use the free Service. By using the Service, you represent and warrant that you meet these requirements and have the legal capacity to enter into these Terms. The Service is not directed to children under 13, and we do not knowingly collect data from them.

4. Use of the Service

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Service in any way that violates any applicable law or regulation;
  • Use the Service to engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Service;
  • Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Service, the server on which the Service is stored, or any server, computer, or database connected to the Service;
  • Use any robot, spider, or other automatic device, process, or means to access the Service for any purpose, including monitoring or copying any of the material on the Service;
  • Introduce any viruses, Trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful.

5. Data Security and Usage

We are committed to protecting your data and maintaining your privacy while using our Service:

  • Data Security: All sensitive data, including your Cults3D access credentials, are encrypted on our servers to enhance security against potential attacks. We implement industry-standard security measures to protect your information.
  • Automatic Data Synchronization: Our Service requires daily automatic data retrieval to function as expected. This synchronization fetches analytical data from the Cults platform to display relevant insights to you. You can disable this synchronization at any time through the settings panel.
  • Data Usage: The information displayed by our tool is retrieved from the Cults platform. We only use the credentials you provide to access your personal analytics from Cults3D. We do not sell or share your data with third parties except as described in our Privacy Policy.
  • Data Deletion: You have full control over your data. You can request to delete all your stored information, including historical records and sensitive data, at any time via the settings panel. This ensures complete privacy and removes all traces of your data from our servers.

6. Service Availability and Limitations

While we strive to provide reliable service, you acknowledge the following:

  • Service Availability: Our service will receive updates and may experience technical issues, system downtimes, or temporary outages. While we strive to minimize disruptions, you acknowledge that occasional service interruptions or errors may occur. We actively monitor and address these issues to reduce impact as much as possible.
  • Liability Disclaimer: Any statistical inaccuracies, errors, or disruptions caused by the Cults platform itself are beyond our control. We are not responsible for issues arising from incorrect or missing data provided by the Cults platform. Our service relies on data provided by the Cults3D API, and we cannot guarantee the accuracy, completeness, or timeliness of this data.

7. Plans, Subscriptions, and Billing

We offer a free plan ("Free") and one or more paid subscription plans ("Premium") with different features, benefits, and usage limits. By using the Service, and in particular by subscribing to a paid plan, you acknowledge and agree to the following:

  • Features and Limits May Change Without Notice: The features, functionality, usage limits, and overall availability of both the Free and Premium plans may be changed, added, reduced, or removed at any time, at our sole discretion, and without prior notice. This includes, without limitation, limits on tracked keywords, historical data retention windows, AI-assisted features, and any other capability of the Service. You acknowledge that no specific feature or limit is guaranteed to remain available during your use of the Service or your subscription period.
  • Recurring Billing Disclosure: The Premium plan costs $19.99 per month (plus applicable taxes). This is an automatically renewing subscription: your payment method will be charged $19.99 every month on a recurring basis, and your subscription will automatically renew at the end of each monthly billing period until you cancel. You will not receive a separate reminder before each renewal unless required by law.
  • Payments and Payment Processor: Payments are processed by our third-party payment processor, Stripe. By subscribing, you authorize us and Stripe to charge your selected payment method on a recurring basis until you cancel, and you are responsible for providing valid and current payment information. We do not store your full payment card details; these are handled by Stripe. Payment processing is subject to the Stripe Services Agreement and the Stripe Privacy Policy, which you accept by providing a payment method.
  • How to Cancel: You may cancel at any time, with no cancellation fee, from the subscription management section of your account settings, or by emailing info@shiningmuffin.com. To avoid being charged for the next billing period, you must cancel before that period begins. Cancellation takes effect at the end of the current billing period; you retain Premium access until that date, after which your account automatically reverts to the Free plan. If your account reverts to Free while exceeding a Free-plan limit (for example, more tracked keywords than the Free limit), existing data is retained but you may be prevented from adding more until you are within the limit.
  • Chargebacks and Disputed Payments: If you initiate a chargeback or payment dispute for a charge that was validly incurred, we reserve the right to suspend or terminate your account and to dispute the chargeback with evidence of your acceptance of these Terms and use of the Service. Please contact us at info@shiningmuffin.com to resolve any billing concern before initiating a chargeback.
  • Pricing Changes: Subscription pricing may change over time. Any change to the price of an active subscription will apply starting from your next billing period, and you may cancel before that period begins if you do not agree to the new price.
  • Refunds: Except where required by applicable law, payments are non-refundable and there are no refunds or credits for partial billing periods, downgrades, or unused features.
  • Taxes: Stated prices may exclude applicable taxes, which may be added at checkout where required.
  • Promotional Offers: We may offer promotional trials or special limited-time pricing or features. Such promotions are subject to the terms specified at the time of the offer and may be modified or withdrawn at our discretion.

Your continued use of the Service after changes to plans, features, limits, or pricing constitutes your acceptance of such changes.

8. Intellectual Property Rights

The Service and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by us, our licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

These Terms do not grant you any rights to use our trademarks, logos, domain names, or other brand features.

9. User Content

The Service may allow you to submit, upload, publish, or otherwise make available content, including but not limited to text, photographs, videos, and other materials ("User Content"). You retain all rights in, and are solely responsible for, the User Content you make available through the Service.

By making any User Content available through the Service, you grant us a non-exclusive, transferable, sublicensable, worldwide, royalty-free license to use, copy, modify, create derivative works based upon, distribute, publicly display, publicly perform, and distribute your User Content in connection with operating and providing the Service.

10. Privacy

Your privacy is important to us. Please review our Privacy Policy and Cookies Policy, which explain how we collect, use, and disclose information about you in connection with your use of the Service.

11. Termination

We may terminate or suspend your access to all or part of the Service, without notice, for any conduct that we, in our sole discretion, believe is in violation of these Terms or is harmful to other users of the Service, us, or third parties, or for any other reason.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

13. Limitation of Liability

IN NO EVENT WILL WE, OUR AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SERVICE, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

14. Indemnification

You agree to defend, indemnify, and hold harmless Shining Muffin LLC and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with: (a) your access to or use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including the terms or rights of Cults3D; or (d) any User Content you submit.

15. Governing Law

These Terms and any dispute or claim arising out of or related to them, their subject matter, or their formation (including non-contractual disputes or claims) are governed by and construed in accordance with the laws of the State of New Mexico, United States, without regard to its conflict of law principles. Subject to the "Dispute Resolution" section below, you and Shining Muffin LLC agree that the state and federal courts located in New Mexico will have exclusive jurisdiction over any dispute not subject to arbitration, and you consent to personal jurisdiction and venue in those courts. The United Nations Convention on Contracts for the International Sale of Goods does not apply. Nothing in this section deprives a consumer of the protection of mandatory consumer-protection laws of their country of residence where such protection cannot be waived by contract.

16. Dispute Resolution; Arbitration; Class Action Waiver

  • Informal Resolution. Before filing a claim, you agree to try to resolve the dispute informally by contacting us at info@shiningmuffin.com. We will try to resolve it within 60 days of receiving your notice.
  • Binding Arbitration. If we cannot resolve a dispute informally, you and Shining Muffin LLC agree that any dispute arising out of or relating to these Terms or the Service will be resolved by final and binding arbitration administered by the American Arbitration Association (AAA) under its applicable rules, rather than in court, except that either party may bring an individual claim in small-claims court.
  • Class Action Waiver. You and Shining Muffin LLC agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding.
  • Opt-Out. You may opt out of this arbitration agreement by sending written notice to info@shiningmuffin.com within 30 days of first accepting these Terms.

Nothing in this section applies where prohibited by the mandatory law of your country of residence.

17. General

  • Severability. If any provision of these Terms is held invalid, illegal, or unenforceable, that provision will be modified to the minimum extent necessary, or severed, and the remaining provisions will remain in full force and effect.
  • Entire Agreement. These Terms, together with the Privacy Policy and Cookies Policy, constitute the entire agreement between you and Shining Muffin LLC regarding the Service and supersede all prior agreements and understandings.
  • Waiver. Our failure to enforce any right or provision of these Terms will not be deemed a waiver of that right or provision.
  • Assignment. You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms freely, including in connection with a merger, acquisition, or sale of assets.
  • Force Majeure. We will not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including acts of God, internet or hosting-provider failures, third-party service (including Stripe or Cults3D) outages, or governmental action.

18. Changes to Terms

We may revise these Terms from time to time. For minor or non-material changes, the updated Terms are effective when posted. For material changes — including changes that materially affect your rights, your subscription, or how we bill you — we will provide reasonable advance notice (for example, by email to the address associated with your account or by a notice within the Service) before they take effect. Your continued use of the Service, or your continued paid subscription, after the effective date of the updated Terms constitutes acceptance. If you do not agree to the updated Terms, you must stop using the Service and may cancel your subscription before the changes take effect.
